Both laws exist because balcony damage is almost never visible from the surface until it’s already structural.

If your building has wood-framed exterior elevated elements — balconies, decks, stairways, walkways, or landings more than six feet above the ground — you’re likely covered under one of two state laws, and the deadlines have already started biting property owners who assumed they had more time.

SB 721 applies to multifamily rental buildings with three or more units. Following Assembly Bill 2579, the compliance deadline was pushed to January 1, 2026, after industry groups flagged a shortage of qualified inspectors. That extension gave apartment owners breathing room, but it’s real and closing fast as of this writing.

SB 326, which added Civil Code §5551 to the Davis-Stirling Act, applies specifically to condominium associations. Its initial inspection deadline was January 1, 2025, and unlike SB 721, it did not receive the AB 2579 extension. If your HOA hasn’t completed its first inspection, you’re not in a grace period — you’re already out of compliance, and associations in that position face daily penalties that can reach $500, along with exposure to negligence-per-se findings if an injury lawsuit follows.

Both laws require inspection of a statistically significant sample of the property’s EEEs rather than every single unit. SB 721 sets a flat 15% minimum sample. SB 326 requires a 95% confidence level with a 5% margin of error, which in practice usually means examining a larger share of the building’s balconies than the SB 721 standard. After the first inspection, both laws require recurring checks every nine years — so an HOA that completed its SB 326 inspection on time in 2025 has its next one due by January 1, 2034.

New condo buildings aren’t exempt just because they’re new. Under SB 326, any condo association where the building permit was submitted after January 1, 2020, has its first inspection deadline set at six years from the date the Certificate of Occupancy was issued, then the standard nine-year cycle after that.

What to Do If You Spot Any of These Signs

The moment you notice cracking, staining, sponginess, or gaps, the right move isn’t to wait for the next scheduled inspection cycle. Restrict access to the balcony if the damage looks significant — a physical barrier or a simple “do not use” notice is a reasonable precaution while you arrange for a professional to look at it. Then call a licensed structural engineer or architect, since California law restricts who’s legally allowed to sign off on these inspections. A contractor without that specific licensing can patch a coating, but they generally can’t produce the report that satisfies SB 326 or SB 721 documentation requirements.

If the inspector finds deficiencies serious enough to threaten “the safety of the structure,” the law requires immediate action — that can mean shoring, closing off the area, or emergency repairs, not just a note in next year’s reserve study. For less urgent findings, associations typically have 120 days from submitting their certification to apply for a building permit to correct the problem.

The Bigger Financial Picture for HOAs

For condo associations, a balcony inspection finding isn’t just a maintenance line item — it has to show up in the reserve study. If your inspector estimates $100,000 in repairs will be needed within five years, your association’s reserve funding plan is now expected to demonstrate that you’re actually saving toward that number, not just noting it exists. 

Boards that skip this step are setting themselves up for a special assessment down the road, which is a far worse conversation to have with homeowners than budgeting for it now.
